AML / KYC

1. General Provisions

  • 1.1. The e-Crypto service carries out AML/KYC procedures within the framework of generally accepted standards:
    • KYC (Know Your Customer) – a procedure for verifying the identity of a client and assessing potential risks from him.
    • AML (Anti-Money Laundering) – a set of measures to combat money laundering in order to identify and prevent the use of the service for illegal transactions. This procedure includes the identification, storage and mutual exchange of information about customers, their profits and transactions between financial organizations and government agencies.
  • 1.2. For this purpose, the Service has the right to use any legal information, third-party means of analyzing the origin of digital assets, as well as its own monitoring systems.

2. Prevention of Illegal Operations

In order to prevent operations of an illegal nature, the e-Crypto Service sets certain requirements for all Applications created by the User:

  • 2.1. The sender and recipient of the Payment under the Application must be the same person. Transfers in favor of third parties are strictly prohibited using the Service.
  • 2.2. All contact information entered by the User in the Application, as well as other personal data transmitted by the User to the Service, must be up-to-date and fully accurate.
  • 2.3. It is strictly forbidden for the User to create Applications using anonymous proxy servers, VPN, Tor or other anonymous Internet connections.

3. Rights of the Service in Case of Suspicious Actions

If the e-Crypto Service reasonably suspects the Client of illegal actions that may be qualified as legalization and laundering, or fraudulent actions or attempts to commit fraudulent actions with digital assets are detected, the Service reserves the right to:

  • 3.1. Require the Client to provide additional information disclosing the origin of digital assets and/or confirmation that these assets were not obtained by criminal means;
  • 3.2. Block the account and any transactions related to the Client, transfer all available information and documents to the financial controlling law enforcement authorities at the place of registration of the Service and, if necessary, at the Client's registration address;
  • 3.3. Require documents from the Client confirming the identity, physical existence, registration address, solvency;
  • 3.4. To return digital assets only to the details from which the transfer was made or to switch to other details after a full check by the Service security service, if it was possible to verify the legal origin of the Client's funds;
  • 3.5. Refuse the Client to withdraw funds to the account of third parties without explaining the reasons;
  • 3.6. Temporarily withhold the Client's funds until the incident is fully investigated;
  • 3.7. The Service reserves the right to monitor the entire chain of transactions in order to identify suspicious transactions;
  • 3.8. The Service reserves the right to refuse to provide the Client with the service if the Service has reasonable suspicions about the legitimacy of the origin of digital assets and holds funds on special accounts of the Service if it is impossible to trace the entire chain of movement of digital assets from the moment of their appearance;
  • 3.9. The Service reserves the right not to disclose information about the methods and results of verification.

4. Refund Terms

Terms of refund of funds stopped for verification based on the results of AML analysis of the transaction:

  • 4.1. Refunds are made after a full check by the Service security service, which may include detailed verification of the sender. Refunds are made minus a fee of up to 10% of the transaction amount to cover the labor costs of processing the request and organizing the refund.
  • 4.2. The refund, subject to approval by the Service, will be processed by the Service within 7 (seven) business days from the date when the User was notified of the Service's decision regarding his/her refund request.
  • 4.3. When making a refund after passing the verification, the User is obliged to confirm the details for receiving a refund.

In connection with the above, the e-Crypto service DOES NOT bear any legal responsibility for using it for the purpose of money laundering, terrorist financing or the purchase of prohibited goods and services, but undertakes to take all possible and available actions to prevent attempts to use the proceeds of crime, terrorist financing or the purchase of prohibited goods and services.
